These Terms and Conditions apply to the website https://donations.sivanandaonline.org which is owned by  The Divine Life Society Headquarters, Sivananda Ashram, PO Shivanandanagar - 249192, Rishikesh, India. 

These Terms and Conditions are governed and interpreted in accordance with laws of India. 

1  Definitions

The use of the following words in these Terms and Conditions (the “Terms”) have a specific meaning: 

• “DLS”, "We", "Us", "Our" refers to The Divine Life Society Headquarters, Sivananda Ashram, India.  
• “Donors”, "You", "Your", "User", "Visitor" refers to the person using this website under these Terms. 
• "this website" refers to https://donations.sivanandaonline.org

2  To whom these Terms are applicable

These Terms apply to all Indian Donors, Foreign Donors, Visitors, Users, Persons who access or use this website to make a donation. 

• Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using this website. 
• Your use of this website is conditional upon Your acceptance of and compliance with these Terms which You agree to be bound by.
• If You do not agree to these Terms and Conditions, then You must immediately stop using this website. You must also agree not to access or use this website.
• You are also expected to check these Terms from time to time to ensure You have taken notice of any changes that may have been made as they are binding on You.

3  Revisions/Changes to Terms

We reserve the right to modify, add or replace Our Terms at any time, based on Our own assessment criteria and at Our sole discretion, and as such, the modified Terms shall be effective immediately upon being posted on this website. Accordingly, Your continued access or use of this website is deemed to be Your acceptance of the modified Terms and Conditions.

5  Copyright & Copyright Infringement

We own all intellectual property rights to this website, including its contents, layout, appearance and underlying website software code. You should not duplicate, reproduce, or copy this website or any of its contents either in part or entirety.

6  Appropriate Use

You agree that You must not knowingly or otherwise, use any form of software tools /code, routines, or devices to interfere or attempt to interfere electronically or manually with the operation or functionality of this website including but not limited to uploading or making available files containing corrupt data or viruses via whatever means. Such attempt will constitute to be a criminal offence and action to be taken by Us. We will also immediately permanently cease Your right to access/use this website.  

7  Changes to this website

• We reserve the right to make improvements or changes (amend, add, remove) to the website features without giving prior notice. 
• We reserve the right to terminate this website, at any time without notice. 

8  Access to the website

• Access to this website is conditional on You using appropriate computer hardware equipment, necessary licensed software, and proper internet access services. 
• We will not be held liable if this website is unavailable due to technical faults at any time or for any period due to circumstances beyond our control. We will, however, at our discretion, aim to give advance notification of any temporary shut down of the website to enable Us to enhance/improve the website service and/or features.  

9  Security of Accounts 

• When You request to Sign-up as a new Indian Registered donor or a Foreign Registered Donor, We will process Your request and at Our discretion, create the appropriate Registered Account only after You have successfully completed the Mobile Phone and Email ID verification steps (e.g. One Time Passcode verifications OTP ). You are then responsible for maintaining the confidentiality of Your Account credentials i.e. Login Id and password at all times for subsequent access. 
• This means You must ensure that it is secure, confidential, only to be used by you as the authorised person, and not to be disclosed to any unauthorised person(s).
• When You request to become a Guest Indian or Guest Foreign Donor, We will process Your request and at Our discretion, create an appropriate Guest Account only after You have successfully completed the Mobile Phone and Email ID verification steps (e.g. One Time Passcode verifications OTP ). You are then responsible for maintaining the confidentiality of Your Guest Account credentials at all times for subsequent access. 
• If You have reasons to believe or suspect that access to Your Account is no longer secure and has become known to unauthorised person(s) (e.g., by loss, theft or unauthorised disclosure), You must promptly change the affected access information (e.g. the password). 
• You must inform Us immediately if You suspect that an unauthorised person/user is using Your Account Login Id or password. 
• You are encouraged to routinely change Your Account password to be compliant with standard information security protocols. 
• We reserve the right to disable an account Login at any time, if, in Our opinion, You have failed to comply with these Security Terms.

10  Information About You

Any information that is collected about You as a Guest or Registered Donor when you make a donation, will be processed in accordance with our Privacy Policy which can be viewed on this website. When using this website, You are giving Your consent to the processing of the information You provide/have provided, and You agree that this information is correct and accurate.  

11  Our Liability

• Our aim is to provide You an online donations feature on this website which is as accurate as possible. The website features on this Website are provided without any guarantees, conditions, or warranties.
• By using this website, You accept that You are doing so at Your own risk and that We will not be liable, or held responsible for any direct/indirect or consequential losses, damages without limitation.

12  Signup Account - Terms

• You must accurately provide all the required mandatory data when You use the system as a new Guest or Signup as a new Registered Account.
• If You have previously created a Registered Account, You will only be able to update certain details relating to Your account. 
• After activation, You cannot delete an Account. It will remain in Our system until such time as We decide to cease any dormant accounts at Our discretion.
• If You request to Us to delete Your account, We will, with best endeavours, disable it but not delete it. This is because of statutory legal requirement to keep donations transactional history for Our Audit and Accounting purposes as per Our governing regulations.      

13  Make Donations - Terms

• As a Donor, You are welcome to make donation(s) towards one or more Donations Fund Types set up on the Website. The Donation denominations under each Fund Type are shown on the Donations page of the website.  
• Donations will be accepted by Us on non-conditional basis. 
• We reserve the right to add, remove, amend Donations Fund Types in line with the Aims and Objectives of Our Society.  Such changes will be communicated via Our official publications. 

14  Make Payment - Terms 

• When transacting your Online donation payment on the Website, You are accepting that You will be redirected to an external third party, ‘Razorpay Software Solutions Ltd’ to be presented with a choice of online payment options on their secure Payment Gateway service. 
• You are responsible for completing the payment process via Your chosen payment method as mandated. We are not responsible for any failed donation Transactions arising from the payment method You choose. We will, however, show you the successful/failed status of the payment transaction. 
• When Your donation transaction is completed successfully, We will issue You with an Online Receipt of Your Donation. It will also be emailed to the Email Id You have given in Your Account. 
• Once a donation payment has been received by Us, a refund of any donations will be at Our sole discretion. If a refund is to be made, it will be transacted via the Payment Gateway process within the timescales established by the Payment Gateway supplier. 
• We reserve the right not to accept a donation if it is deemed conditional or unlawful. We will refund such donations directly via the Payment Gateway process. 

15  Linking To This Site

You should not establish a link of any pages on this website to any other external websites to suggest any form of association, approval, or endorsement on Our part where none exists.
